When can I access my rental property?

 

Strict guidelines need to followed to access a rental property.

The tenant has the right to have quiet enjoyment of the property they are renting.

 

This means the owner/property manager must not interfere with the tenant’s peace, comfort and privacy in using the premises.

However, if the owner/property manager does need to gain access to the property to carry out maintenance and management tasks, they must follow strict guidelines to access the property. 

What reasons can a lessor/agent enter the property:

·         To inspect and carry out repairs

·         Check the tenant has fixed a significant breach

·         To comply with smoke alarms and safety switch

·         To show prospective tenant or purchaser through the property

·         To carry out a valuation

·         Check if the property has been abandoned

The amount of notice given to the tenants will vary on the reason for entering. The lessor/agent can only enter the property during the time period specified on the Form 9 Entry Notice which is issued to the tenant prior to entering the property.
